Terms of Use

These terms explain how ARK accounts, ordering, payments, pickup, promotions, and Lab Points work.

Agreement and operator

These Terms of Use form an agreement between you and ARK COFFEESHOP INC., operating as ARK T-LAB at 1015 Bronte St. S, Milton, Ontario L9T 8X3.

By using the ARK website or app, creating an account, or placing an order, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.

Eligibility and accounts

  • The account program is intended for customers aged 13 and over.
  • You must provide accurate account and pickup information and keep it current.
  • You are responsible for activity performed through your account and for protecting your email, password, social sign-in, and device access.
  • One person should not operate multiple accounts to obtain duplicate welcome rewards or evade promotion limits.
  • We may restrict accounts reasonably associated with fraud, payment abuse, security threats, harassment, or misuse of promotions.

Orders and prices

  • Mobile orders are prepaid, ASAP orders for dine in or takeaway from the ARK counter.
  • Prices are shown in Canadian dollars. Applicable HST is calculated before payment.
  • The app validates current products, modifiers, availability, promotions, tax, and totals before charging.
  • An order is accepted when payment succeeds and the app displays an ARK order number.
  • Estimated preparation times are estimates, not guarantees, and may change during busy periods.
  • We may reject or cancel an order affected by an obvious pricing error, unavailable item, payment problem, suspected fraud, safety issue, or circumstances outside reasonable control. Any applicable refund will be returned to the original payment method.

Pickup

Dine-in and takeaway mobile orders are collected at the ARK pickup counter. Customers should present or state the ARK order number and collect the order promptly after it is marked ready.

Customers are responsible for checking that the pickup location, order details, allergens, and customizations are suitable before paying.

Cancellations, refunds, and order concerns

Cancellation may be available only before preparation begins. Prepared or uncollected orders are generally non-refundable, except where an item is incorrect, missing, defective, or a refund is otherwise required by law.

Lab Points

  • Members earn 10 Lab Points per $1.00 of eligible net spend after discounts and before tax or tip.
  • 1,000 Lab Points can be redeemed for a $5.00 reward when redemption is available in the app.
  • New members receive 250 welcome points after their first completed paid order.
  • Points are awarded after an order is completed and can be reversed for cancellations, refunds, chargebacks, or abuse.
  • Points do not expire under the initial program, have no cash value, cannot be sold or transferred, and cannot be combined between accounts.
  • One points reward or one coupon may be applied per order at launch.
  • We may correct point errors and adjust or end the program with reasonable notice, subject to applicable law.

Coupons and promotions

Promotions can have start and end dates, minimum spend, customer eligibility, product restrictions, usage limits, and maximum discounts. Unless a promotion says otherwise, codes cannot be combined and have no cash value.

ARK may reject duplicate, automated, altered, resold, expired, or improperly obtained promotions.

Payments

Payments and optional saved cards are processed by Square. ARK does not receive full card numbers or security codes. Your bank, card network, wallet provider, and Square may apply additional terms to the payment.

Allergens and product information

Products can contain or come into contact with milk, soy, gluten, nuts, caffeine, and other allergens. Customization does not guarantee allergen separation. Customers with allergies or dietary concerns should contact ARK before ordering and should not rely solely on app descriptions.

Acceptable use and intellectual property

You may use the service only for lawful personal ordering and account activity. You may not interfere with the service, test it without authorization, automate promotion abuse, impersonate another person, submit harmful content, or attempt to access non-public systems.

ARK names, logos, product names, designs, photography, copy, and software are owned by or licensed to ARK COFFEESHOP INC. They may not be copied or commercially reused without permission.

Availability and responsibility

We work to keep the service accurate and available, but maintenance, internet failures, provider outages, menu changes, and other interruptions can occur. To the maximum extent permitted by law, ARK is not responsible for indirect or consequential losses arising from use of the service.

Nothing in these terms excludes rights or remedies that cannot legally be excluded.

Changes and contact

We may update these terms as the service develops. The current version and effective date will be posted here. Ontario law and applicable Canadian law govern these terms.
